Procedure voor Kenia Deel 2/4 - (adoption) Procedure Kenya Part 2/4

Na een korte pauze, vanwege computerproblemen en een gezellig bezoek van Ruth!
Hebben we nu alles geupdate, de Tijdslijn, het Blog Overzicht en de Nairobi aanbevelingen.

Hallo Allemaal,

In augustus vorig jaar had ik al wat geschreven over onze 2de adoptieprocedure die nu natuurlijk,
"live"  plaatsvind in Kenya. En we zitten nu dus midden in de procedure.

We hebben ons eerste "huisbezoek" gehad van de maatschappelijk werkster (J.) van CWSK (Child Welfare Society of Kenya)  die samen kwam met P. van Grace Children's Center, het kindertehuis.
En we hebben het 2de bezoek aan het CWSK kantoor ook gehad.Met ons viertjes gingen we daar op bezoek.
In plaats van J. onze contactpersoon vanaf aankomst werden we voorgesteld aan P. die blijkbaar ook het rapport gaat schrijven voor de rechtbank.Het was een kort gesprek waarbij zij, naar ik meen, maar 3 vragen heeft gesteld, binnen 1 uur stonden we weer buiten.

J.,(of P) onze contactpersoon zal dus 3 keer contact met ons hebben, nu wij de pleegouders zijn van Kieran gedurende 3 maanden; in principe is dat september, oktober en november, waarna ze een rapport over ons schrijft.

1ste bezoek Thuis (half september)
2de bezoek Kantoor CWSK (begin oktober)
3de bezoek Thuis (?) met de gehele familie, waarna het rapport volgt en we op weg gaan naar de volgende stap...

Nu moeten we een advocaat in dienst nemen die ons vertegenwoordigd bij de 3 hoorzittingen in het Hogere Gerechtshof waarbij wij als ouders, beide en Kieran aanwezig moeten zijn.
(en zo hebben we gehoord het ook goed is dat Matthew erbij is)
En, jawel ook deze stap hebben we gezet.We hebben meneer O.O. gesproken en hem in dienst genomen voor onze procedure.(contact gegevens van de advocaat per email op te vragen bij ons)
Hij heeft ons veel verteld en duidelijk gemaakt over de procedure.Hij heeft ons andere in contact gebracht met een 'Guardian ad Litem' die we nog moeten gaan spreken.
Ook vertelde hij een A5 familie foto nodig te hebben voor het dossier.(al die witte mensen zien er ook allemaal hetzelfde uit)
Alles wat hij doet is erop gericht dat we de 1ste rechtbank hoorzitting zo snel mogelijk na 25 november hebben (einde pleegzorg periode) en nog voor de kerstvakantie vanaf 21 december.
Een Guardian ad litem (vriend van het kind) moet benoemd worden door het Nationaal Adoptie Committee om op te komen voor de (onafhankelijke) belangen van het kind.

Na de 1ste rechtzaak hebben we afspraken met het Ministerie, afdeling kinder welzijn zodat hun ook een rapport kunnen schrijven over onze familie.

Als alles naar wens verloopt en de adoptie uitspraak gedaan is door de rechter dan moet het CWSK dit binnen een week doorgeven aan Wereldkinderen.

Dan komt er een adoptie certificaat door de  klerk die verantwoordelijk is voor de Geboorten & Overlijdens registraties. Dit vervangt een geboorteakte, die Kieran niet heeft, en daarmee kunnen we straks een paspoort voor hem aanvragen.

Met een pak papieren:
- Adoption Order, and - en  (Adoptie uitspraak) Adoption Certificate.
- Clearance letter from Kenyan Department of Children's Services-Ministry of Home Affairs.
(Brief die aangeeft dat het kind het land mag verlaten)
- Travel document(s) issued by Immingration Department Kenya.(dus nog een brief)
- Visa van de Dutch Embassy in Kenya in Kieran's paspoort. (Visum uitgegeven door de NL ambassade)
Als het goed is zal CWSK - WK en onze advocaat ons hierbij begleiden om alle documenten te verzamelen, verkrijgen.

Na de adoptie moeten we de update rapporten gaan schrijven.
Elke 3 maanden voor 2 jaar (dus tot tot circa 7 jaar oud in ons geval) na de adoptie uitspraak.
Dan jaarlijks voor 3 jaar, of wel bij ons, tot 10 jaar oud.

Oh, en we,Kieran, mijn zus Wilma en ikzelf gingen naar Karen Surgery voor een controle.
We hadden wat vragen en Kieran was hier al eerder geweest voor zijn medisch dossier.
Alles is goed en Kieran groeit goed en ziet er goed uit volgens de Nederlandse dokter.

In de titel kun je zien dat dit deel 2 van 4 zal zijn, teminste dat is onze verwachting!
Deel 3 zal gaan over de Rechtbankprocedures en het einde van de fosterperiode.
Deel 4 zal terugkijkend zijn naar de totale procedure en hoe wij die beleefd hebben.

We have now updated the timeline and summary & also the Nairobi recommendations.

Hello everyone,

In August last year I started this blog about our second adoption procedure, which is now happening 'live' in kenya.  And we are now halfway through the procedure.

We've had our first 'home visit' from the social worker (J.) from CWSK (Child Welfare Society of Kenya)  who came together with P. from Grace Center, the children's home.
And we also had the 2nd visit to the CWSK office.With the four of us we went to see them there.
Instead of J. our contact since we arrived in Kenya, we were introduced to P. who also seems to write the report for the court.It was a short conversation really during which she only asked 3 questions, as far as I can remember, within the hour we were outside again.

J.,(or P) our contact person, will have official contact with us 3 times now that we are Kieran's foster parents for 3 months; in principle that is September, October and  November, after which she will write a report about us.

1st visit at home (mid-September)
2nd visit at the CWSK office (early October)
3rd visit at home (?) with the whole family, after which the report will follow and we will be on our way to the next step...

Now we need to hire a lawyer who will represent us in the 3 court hearings at the High Court, during which both of us as parents and Kieran, need to be present. (and probably Matthew too, as a family)
And yes, we also have done this.We had a meeting with mister O.O. en hired him to represent us during our procedure.(contact details of the lawyer can be asked by email from us)
He has told us a lot and clarified the procedure.He has set up a meeting with a possible 'Guardian ad Litem' who we still have to go and meet.
He also told us that he needed an A5 family photo for the file.
Everything he does is aimed on having the first court hearing as soon as possible after the 25th of november (end of the Foster Period) and before the 21st december court recess.
A Guardian ad litem (friend of the child) has to be appointed by the National Adoption Committee to (independently) represent the child's interests.

After the 1st court case we will have meetings with the Ministery, Children's Department.
Who will also meet with us and write another report about our family.

If everything goes to plan and after 6-9 months, and the adoption decision is read out by the judge
and signed, then CWSK has to give this to Wereldkinderen (our adoption agency in the Netherlands) within a week.

Then the clerk of the court will create the Adoption Certificate, this person is responsible for registering births and deaths.This document replaces the birth certificate which Kieran does not have, and with that we can then apply for a passport for him.

A mountain of paperwork to collect:
- Adoption Order, and (Adoption Decision),  Adoption Certificate.
- Clearance letter from Kenyan Department of Children's Services-Ministry of Home Affairs.
(Letter that confirms the child can leave the country)
- Travel document(s) issued by Immingration Department Kenya.(Another letter)
- Visa from the Dutch Embassy in Kenya in Kieran's new passport

Hopefully CWSK, WK and our lawyer will guide us in the collection of all these documents.

After the adoption is final in Kenya, we have to write 'update reports'; every 3 months for 2 years (so till Kieran is about 7 years old) ) And than yearly till he is 10 years old.

Oh, and we,Kieran, my sister Wilma and myself went to Karen Surgery for a check up.
All is well and Kieran is growing well and looks good according to the Dutch doctor.

In the title you can see that this is part 2 of 4, at least that is our expectation!
Part 3 will be about the Court Procedures and the end of the foster period.
Part 4 will be looking back at the total procedure and how we experienced it.
