Hier een overzicht van wat er allemaal gebeurt eenmaal in Kenia tijdens de adoptie procedure-

Bij aankomst in Kenia wordt je meestal ontvangen door een vertegenwoordiger van 1 van de 4 adoptie vergunninghouders in het land. ( KKPI - KCH - LAN - CWSK)
(Het is goed om al snel uit te vinden of je contact persoon ook degene is die het uiteindelijke rapport voor de rechtbank gaat schrijven en dus de huis bezoeken moet doen.  Bij ons was dat niet zo, ze bleek een counsellor te zijn en geen bevoegde sociaal werker).

Je gaat, vaak de volgende dag al, voor 2 - 7 dagen op bezoek bij jullie kind
Dit hangt af van wat je vergunninghouder en het kindertehuis hebben afgesproken en hoe het kind reageert.
De vergunninghouder moet een sociaal werker aangesteld hebben als contactpersoon voor het gezin.

Als het kind met jullie mee mag komen dan teken je een Care Agreement (Zorg Overeenkomst)
voor de pleegzorg voor 90 dagen. (Legal Fostering Period).  Meestal mag het kind alleen met je mee als je al een woning hebt (en dus niet meer in een hotel/pension/B&B verblijft).

Gedurende de pleegzorgperiode van 90 dagen geeft de (Keniaanse) vergunninghouder je advies voor een Advocaat en Guardian ad Litem. (Als je informatie hebt van andere ouders, probeer dit dan te 'sturen' de juiste advocaat heeft ervaring en spreekt een vast tarief af, soms wordt dit allemaal gedaan door de vergunninghouder. Idem voor de Guardian, vast tarief - duidelijke afspraken - en ervaring ).  Bij ons, omdat wij het eerste gezin waren vanuit onze Nederlandse vergunninghouder en een experimentele case waren voor onze Keniaanse vergunninghouder, moesten we zelf een advocaat vinden.  Dat hebben we gedaan door te vragen aan andere Nederlandse ouders.  In ons geval, stelde de advocaat een Guardian ad Litem voor.

Deze beide personen zullen meestal gedurende de 90 dagen een afspraak met je maken om de 1ste rechtzitting (1st Hearing) in High Court voor te bereiden.De 1ste rechtzaak vindt pas plaats na 90 dagen als de pleegzorgperiode voorbij is en de Keniaanse vergunninghouder hun rapport hebben ingediend.

De Guardian ad Litem is meestal een sociaal werker die ervaring heeft met adoptie. (Het is verstandig om alvast kennis te maken met de Guardian ad Litem tijdens de 90 dagen).

De 1ste rechtzitting is er om de Guardian te laten benoemen door de rechter.
Aanwezig: beide ouders en kindje (onze advocaat zei dat het verstandig is om de andere kinderen uit het gezin er ook bij te laten zijn, je presenteert je dan als een familie), de advocaat en de Guardian.

De Guardian doet ook daarna nog een aantal huisbezoeken.

 In de rechtbank dient iedereen netjes (formeel) gekleed te zijn, iets wat men vaker verwacht in Kenia.

Na de 1ste rechtbank zitting is er een "standaard periode van 45 dagen"  waarna de 2de Rechtzitting (2nd Hearing) plaats zou moeten vinden. (Het is verstandig als de advocaat dit uitspreekt in bijzijn van de rechter om deze 'tijdslimiet' officieel te bevestigen).  De Guardian bezoekt je een aantal keer thuis om het rapport te schrijven, het aantal keer is afhankelijk van de Guardian. (Wij ontmoeten hem 3x thuis en de 1ste keer bij de advocaat om kennis te maken).  (Het rapport lijkt op het rapport wat in je land van herkomst is geschreven < NL: Kinderbescherming>).

Ook tijdens deze periode zal de advocaat contact zoeken met het Childrens Department. Deze afdeling van het Ministerie is verantwoordelijk voor (Internationale) Adoptie. Het Childrens Department zal een Child Officer aanstellen die verantwoordelijk is voor jullie zaak, de advocaat maakt een afspraak voor je met deze persoon. Dit intervieuw duurt 1 tot 2½ uur en is alleen met beide ouders op het kantoor in Electricity House. De Child Officer zou alle informatie gehad moeten hebben en het hebben gelezen. Maar het is verstandig om zelf een korte samenvatting mee te nemen met: scholen-onderwijs, banen-titels etc. Dit alles chronologisch en in het Engels. Voor dat de afspraak voorbij is zal er een nieuwe afspraak bij jullie thuis gemaakt moeten worden meestal binnen 3-10 werkdagen.

De Child Officer zal bij jullie thuis komen om te kijken naar de leefomstandigheden en voorzieningen.
Deze afspraak is meestal kort(er) en duurt tussen de 10-60 minuten.

De Guardian ad Litem, het Childrens Department en de Keniaanse Vergunninghouder schrijven allen een rapport.  Deze en andere documenten* worden door de advocaat ingediend bij de rechtbank. (Onze advocaat wilde ook een A5 foto van ons als 'compleet' gezin als deel van ons dossier). De advocaat spreekt een datum af voor de 2de rechtzitting.

Het doel van de 2de rechtzitting is om alle documenten en rapporten over de adoptie te presenteren aan de rechter-rechtbank. Als alles in orde is, kan de rechter nu al uitspraak doen (Judgement) maar dit komt zelden voor. Aanwezig zijn: ouders en kindje (kinderen), de advocaat, de Guardian, Childrens Department en de vergunninghouder. (De advocaat regelt dit, iedereen moet er zijn of de zitting wordt uitgesteld). Meestal geeft de rechter een datum voor de Uitspraak die ligt tussen de 2 weken tot enkele maanden later. (Sterk afhankelijk van de drukte in de rechtbank en de rechter die je hebt, zie onderaan).
Het is goed om bij de Uitspraak (3rd Court) aanwezig te zijn, overleg dit met de advocaat! (Er wordt gezegd dat bij drukte de aanwezige ouders voorrang krijgen, maar wj hebben hier geen bewijs van gezien of gehoord.  Wij  waren niet aanwezig < en ook de andere Nederlanders niet>; onze Judgement datum werd steeds geschoven en werd uiteindelijk 3 weken later dan de oorspronkelijke datum die werd genoemd tijdens de 2e Rechtzitting.  Op een avond werden we gebeld dat de Judgement uitgesproken werd zonder dat we het eens wisten dat het ging gebeuren, dus we kregen de kans niet om aanwezig te zijn.

De rechter leest de Uitspraak (Judgement) voor aan de advocaat en griffier; dit kan op elk moment van de werkweek gebeuren, de andere zaken zijn altijd op vrijdag ochtend tussen 09.00 en 13.00.

Na de uitspraak is het goed om, samen met de advocaat alles op een rijtje te zetten:
Wie moet wat, waar en wanneer doen? Lees alle documenten nogmaals goed door op correctheid en vooral de juiste spelling!

Als de Uitspraak (Judgement) gedaan is dan schrijft de advocaat de Adoption Order, die door de Rechtbank getekend wordt. Dit zou binnen 5 - 10 werkdagen moeten zijn.

Als de Adoption Order getekend is dan vraagt de advocaat het Adoption Certificate aan bij de Registrar General.  Dit zou binnen 7-14 werkdagen moeten zijn.

De advocaat moet nu beide documenten kopieren : Adoption Order en Adoption Certificate en certificeren, Certified Copies, en hiermee kan je de Certificate of Conformity aanvragen.  De originelen gaan naar nu naar het Ministerie van Buitenlandse Zaken (Harambee Avenue) voor legalisatie, dit is meestal binnen 1 dag klaar.  Soms doet de advocaat dit (maar zoek uit of dit inclusief in de prijs is, of of je het extra moet betalen. Het kost 1000 KSH per document, maar je kunt dit ook zelf doen.

Nu kun je zelf het Certificate Of Conformity (COC - Article 23 form) aanvragen bij het Childrens Department, dit kan 1 van de ouders doen en duurt 3-10 werkdagen.
Benodigde formulieren voor de aanvraag:
- Aanvraagformulier COC ingevuld
- Adoption Order, certified copy
- Adoption Certificate, certiefied copy
- Copy paspoorten beide ouders
- Copy Freeing Certificate, te krijgen via de Keniaanse Vergunninghouder
- Copy of Approval letter NAC, te krijgen via je (Nederlandse) Vergunninghouder
- Copy van Approval van je thuisland. (NL: Beginseltoestemming Justitie)

Dit document, COC, moet getekend worden door 2 personen en dit kost vaak tijd.

Als je het COC hebt, het Childrens Department belt je als het klaar is, dan kun je een paspoort aanvragen.

Voor een Keniaans paspoort heb je alle originele documenten nodig bij de aanvraag en de aanwezigheid van beide ouders en het kind bij Immigration in Nyayo House. 
De Keniaanse vergunninghouder kan je hierbij (laten) assisteren of vraag de hulp van Rebecca L. 
(zie ook Nairobi Recommended page in de blog). 
Het Keniaans paspoort duurt van 3-10 werkdagen, Express service is 3 dagen en is duurder (300 euro). Normaal is 10 dagen en kost rond de 40 euro/4500 KSH.

- a copy of the recommenders national ID

Na het Paspoort moet er soms een Exit stamp gehaald worden, alleen bij 'buitenlandse' paspoorten.
In ons geval met een Keniaans Paspoort moet er een Visum & MVV (Nederland) gehaald worden. De MVV wordt enkele weken van te voren aangevraagd door de Nederlandse Vergunninghouder via Justitie en wordt gemaild naar de Nederlandse Ambassade waar je het ophaald als je zover bent.

En voor het Visum natuurlijk de vlucht terug boeken voor jullie allemaal!

Timelines are in italics; all timelines are minimum-maximum as far as we know and in our experience.  Documents are in bold.  Advice is underlined.

On arrival in Kenya at the airport you are usually met by a representative of one of the 4 adoption licence holders in Kenya which your home country adoption agency is working with ( KKPI - KCH - LAN - CWSK).   (It is a good idea to find out quickly if your contact person is also the one you will be meeting with and if that person has the authority to write the report and appear in court. In our case the lady who met us was a counsellor and not an authorised social worker; we did not meet her for several weeks).

You usually meet your child the following day already, and visit for a period of between 2 - 7 days. This depends on what the adoption agency and the children's home have agreed and on how the child reacts to you.  The adoption agency should assign you a social worker who will be the contact person for your family.

When the time comes to take your child home with you, you sign a Care Agreement (7th Schedule) agreeing to foster your child for 90 days. (Legal Fostering Period).  Usually the child is only released into your care when you have a permanent home (apartment or house for your duration in Kenya) and are not/no longer staying in a hotel or B&B.

During the 90-day foster period, the Kenyan adoption agency will arrange a lawyer and Guardian ad Litem for you. (If you have any say in this, use the experience of other adoption families and try and arrange to get the right lawyer who has experience and charges a set fee.  But you may not have any say in the matter.  Same for the Guardian, look for a set fee, clear agreements and experience - if you have any say in the matter). In our case because we were the first family in an experimental procedure in Kenya from our Dutch agency and because we were also an experimental international adoption case for our Kenyan agency too, we had to find our own lawyer.  We asked for recommendations from other Dutch families.  Our lawyer also found an experienced Guardian ad Litem for us.
Both these people will usually make an appointment with you during the 90-day period to get to know you and inform you of the procedures/prepare you for the first court hearing in the High Court.  This hearing will take place after the 90 day period is over, when your Kenyan agency has filed their report, which allows the lawyer to submit a complete adoption file to the court. (In our case instead taking place after 3 months, the first court case didn't take place till 5 months later - 2 whole months after the 90-day period was over).

The Guardian ad Litem is usually an independent (or ex) social worker by profession who has experience with adoption.  (It is wise to get to know the Guardian ad Litem during the 90 dagen although he/she doesn't officially start their report till after the 1st court hearing).

At the first court hearing, the Guardian is officially appointed by the judge.  Present should be: both parentsm the child (our lawyer recommended other children in the family also attend to present a family unit to the judge), the lawyer and the proposed Guardian.

Everyone should be dressed smartly (formally) in court, something people expect in Kenya.

At the first hearing, the judge will tell the Guardian and the lawyer that within a "standard period of 45 days" he would like to receive the family reports from the Guardian and Children's Department.  After this time, the second hearing can take place. (It is a good idea for the lawyer to confirm this with the judge in everyone's presence).  The Guardian will then visit you at home a number of times at their discretion and also speak to any other children in the family.  (Our Guardian visited us 3 times after the first time we met him at our lawyer's office).  When he/she is satisfied, they will write a report stating their recommendation on the adoption that is submitted to the court. (The report is similar to the report that is written in your home country during the initial screening period (in The Netherlands this is done by the Raad voor de Kinderbescherming (Child Protective Services).

Also during this time, the lawyer will make an appointment for you with the Childrens Department. This Ministerial Department is responsible for (international and domestic) adoption. A Child Officer will be appointed to your case.  The first meeting will take place at their offices in Electricity House and will last anywhere between 1 to 2½ hours and is only for the parents.  The Child Officer should have received your file including all the documents on your case and have read this.  Because of the thoroughness of the Guardian's questions, in advance of this meeting we put together some information on both of us regarding out families, schools, education, jobs, work history, titles and dates which we could give to the Child Officer.  This was in English and in chronological order and the Child Officer was very pleased with the information and kept it. At the end of the appointment, a new appointment is set for a home visit where the child should be present as well as any other children in the family.  This is usually within 3-10 working days.

The Child Officer will come to your home to look at the living arrangements and facilities, security and so on.  This is usually a short(er) appointment and can take anywhere between 10-60 minutes.

As well as the Kenyan adoption agency, the Guardian ad Litem and Childrens Department will write a report which is submitted to the court before the 2nd court hearing can be held. The lawyer will get a date for the second hearing from court and let you know a few days in advance.

The purpose of the second hearing is for all the documents and reports regarding the adoption to be presented to the judge and for the Guardian, Children's Department representative and Kenyan adoption agency social worker to state that they agree to the adoption. If everything is in order, the judge can make his ruling immediately (if he has pre-read all the documents) but more usually agree a date to make the Judgement.  Present should be: the parents and child (children), the lawyer, the Guardian, Childrens Department and adoption agency.  (The lawyer arranges for everyone to be there and if they are not, the hearing will be postponed - to later in the day (in our case!) or another day). Usually the judge will give a date for the ruling or Judgement which is anything between 2 weeks to several months later. (Very much depending on the workload of the court and the judge and anything else going on in the country that can take a judge away from court.

If possible it is good to be present for the Judgement/3rd court hearing - discuss this with the lawyer.  (We have heard that during a busy day, the judge reads the rulings out first for the parents who are present, but we have not seen or heard any evidence of this.  We were not present for our reading of the Judgement (nor were any of the other adoptive Dutch parents we know); our own Judgement date was moved and moved and finally took place about 3 weeks after the original date we were given in the second hearing).  We got a surprise phone call about 9pm one evening from our lawyer that the Judgement had been read that day without us even knowing it was going to happen that day so we didn't get the chance to be in court at all. 

The judge reads the Ruling (Judgement) to the lawyer and clerk; this can take place at any time of day on any day of the working week, whereas other hearings are always on Friday mornings between 9am - 1pm.

After the judgement, it is a good idea to make an appointment with your lawyer to discuss the next steps, who should do what and when? 

When the Judgement has been read, the lawyer will write the Adoption Order, which is signed by the court.  This should take place within 5 - 10 working days.  (Ours was ready in 10 days). When you get a copy of this (our lawyer e-mailed a copy), you should read it carefully for accuracy of names and dates and spelling.

When the Adoption Order has been signed, the lawyer will apply for the Adoption Certificate at the Registrar General's office.  This should be ready within 7-14 working days. (Ours was ready in 4 days).

The lawyer should now make a certified copy of the Adoption Order and Adoption Certificate which you can use to request the Certificate of Conformity.  He will send the originals to the Ministry of Foreign Affairs (Harambee Avenue) for legalisation, this is usually ready within 1 day.  You can also elect to do this yourself, but if your lawyer does it check if this service is included in the fee you are paying or if it is extra.  Cost is 1000 KSH per document. 

But the certified copies are sufficient to request the Certificate Of Conformity (COC - Article 23 form) at the Childrens Department; one parent can go alone to do this and the child does not have to be present.  This takes 3-10 working days. (Ours took 10 days).

Forms required for the request:
- Conmpleted COC request form
- Adoption Order, certified copy
- Adoption Certificate, certiefied copy
- Copy of both parent's passports
- Copy of the Freeing Certificate, which you will have got from the Kenyan adoption agency
- Copy of Approval letter NAC, which you will have got from your home adoption agency
- Copy of Approval to adopt from your home country (in The Netherlands this is the Beginseltoestemming from the Ministry of Justice)

The COC has to be signed by 2 people, one from the Children's Department and one representative from the National Adoption Committee, which takes time.

When  the COC is ready, the Childrens Department will call or text you (you cannot contact them) and then you can apply for the passport.
To apply for a Kenyan passport , you must take original documents and both parents and the child are required to be be present, at Immigration in Nyayo House. 
The Kenyan adoption agency can help you with this (not in our case) or you can ask for help from Rebecca Lusweti who runs an immigration support service. (- also see Nairobi Recommended page in the blog).  The Kenyan passport takes 3-10 working days, but an express service of 3 days is offered  but this also costs 34,400 KSH/300 euros.  Uusual timeline is 10 days and the cost is around 40 euros/4500 KSH.

Photos for the passport can be made at recognised photograph shops either in Junction, 1st floor by the Foodcourt, at YaYa Centre or at Sarit Centre.

Sometimes once the passport is ready, you have to get an Exit stamp but this is only in non-Kenyan passports.
In our case because Kieran has to travel on a Kenyan passport, we have to get a visa-MVV
(temporary residence permit) for The Netherlands from the Dutch Embassy. The MVV needs to be applied for beforehand by the Dutch adoption agency at the Ministry of Justice in the Netherlands and is e-mailed to the Dutch Embassy in Nairobi where you can collect it when you are ready.
And don't forget before you can apply for the visa, you have to book your flight home for all of you!
