Adoption Procedure 3B - De Adoptie Procedure 3B

Ergens eerder in deze serie over de procedure heb ik gezegd dat er 4 delen zouden zijn, nu klopt dit wel ten dele ;-)
Na deel 3A dan nu 3B, vanaf  the Judgement tot aan het afronden van de Keniaanse Procedure hier.

En toen op 4 april om 21.00 kregen we de SMS 'Your Judgement was delivered today and the Adoption is granted'. De week erna bleef het stil waarna we op de 18de April de Adoption Order gemaild kregen.

Adoption Certificate: dit document vervangd (nu nog, men wil dit vervanderen) het geboorte certificaat en komt van de Registrar in Sheria House, bij ons kwam dit een week na de Adoption Order.

The Judgement (op papier): de Uitspraak wordt op papier uitgetypt en omdat we dit (werd gezegd voor het paspoort) ook nodig hadden hebben we deze ook opgevraagd bij de advocaat, alleen (helaas) was de "onze" niet getekend door de rechter ... Dus uiteindelijk vandaag (10-05-2013) opgehaald.

Legalisaties - certified copies:  De Adoption Order en Certificate moeten gecertificeerd worden door de advocaat want deze beide zijn nodig voor het aanvragen van het COC, Certificate of Conformity.

Oh, van onze advocaat hebben we ook nog ons dossier (althans een copie) gekregen met  bijna alle documenten erin, wat handig is voor de evaluatie met onze vergunninghouder in Nederland.

COC (certificate of conformity, artikel 23 Alle adopties volgen het Haags Adoptieverdrag -- article 23 all adoptions follow the Hague Convention ) We vroegen dit document aan (met het aanvraag formulier, zie lijst in bericht 4) op vrijdag 26 april bij het Childrens Department. Op hetzelfde adres waar we eerder al een interview hebben gehad. De meneer, die er ook was bij onze 2de rechtzitting, zei dat het binnen een week klaar zou zijn...
Helaas toen ik een week later ging informeren was er nog niets gebeurd met onze aanvraag.
Het document heeft een officeele zegel en moet getekend worden door het hoofd van het Childrens Department en door de voorzitter van de NAC - National Adoption Committee, die beide handtekeningen zijn meestal het probleem.

Gelukkig kregen we gisteren, donderdag 09 mei een SMSje dat het COC voor ons klaar lag, en gingen we het vandaag (vrijdag 10 mei 2013) ophalen!

Paspoort
Omdat onze procedure al een tijdje loopt (we zijn begonnen met de 2de adoptie in 2006) hebben we een oude 'beginsel toestemming' (Verklaring van het Ministerie van Justitie in Nederland).
Wat als gevolg heeft dat we alleen een Keniaans paspoort kunnen aanvragen en geen Nederlands.

Vandaag, (vrijdag 10 mei) was het dan zover en gingen we samen met een bemiddelaar de aanvraag doen voor Kieran zijn 1ste paspooort! (zie lijst in bericht 4).  Na alles samen juist te hebben ingevuld moest ik (Peter) tekenen.Wat we wel grappig vonden omdat we er allebei bij moesten zijn en wij niemand gesproken hebben ;-)   Kieran moest serieus kijken en stilzitten (best een lastige combinatie als je 4 bent) voor een digitale foto en na 45 minuten stonden we weer buiten.

We hebben gekozen voor de "Express Methode" waar je een beetje meer voor betaald, maar nu weten we al dat we aankomende dinsdag het paspoort 's avonds thuis gebracht krijgen!

Visum & MVV
Ja, en dan nog 1 stap in 2 delen, Naar de Nederlandse Ambassade en daarvoor het vliegticket boeken.
Om een visum aan te vragen voor Kieran moeten we een terugvlucht geboekt hebben.
Maar ja, dan moeten we wel zeker weten dat het visum op tijd klaar is !!!
Dus aankomende maandag 13-05 eerst maar eens even bellen met de Ambassade.
Wat we al wel weten is dat de MVV (machtiging voorlopig verblijf) goedgekeurd is en voor ons klaar ligt, dit was goed geregeld door Wereldkinderen in Nederland met ons en de Ambassade. (Dit zorgt ervoor dat Kieran ook na de afloop van het visum in Nederland mag blijven bij ons).

Onze Visa  (voor in Kenia) ...
Afgelopen donderdag "hadden we crisis beraad" we hadden tot laat in de middag niets gehoord over de COC en hoorden wel dat het Departement 2 weken ging sluiten (!) Dusss .................
Effe crisis in de tent. Want op dinsdag 14 mei lopen de Visa van ons 3 af na 9 maanden in Kenia.
(Vernieuwen kost wederom een boel centjes en voor hoelang dan ?) *
Als het Childrens Department het COC nog niet voor ons had op vrijdag (vandaag) dan zou het pas vanaf 27 mei weer mogelijk zijn dachten we. Enne de afspraak was dat ik in mei weer zou gaan werken!

Dus een snelle koffie bij Java Adams Arcade en Plan B bespreken,  
Wat Als ???
(Ikke naar huis vliegen samen met Matthew - Jane en Kieran blijven in Kenia en we regelen een verklaring op schrift voor paspoort en visum voor Kieran bij-via de advocaat dachten we).

* We hebben nu dus overlegd met onze conatct person en gekozen voor de kortste (goedkoopste) verlenging van 2 weken wat ons tot 28 mei brengt.

Tja,wanneer komen we dan naar huis ?
Dat weten we dus pas zeker volgende week als we het paspoort in handen hebben, zeker zijn van de visa datum en geboekt hebben.  Waarschijnlijk pas na de Pinksterdagen (die men hier overigens niet kent of viert) en dan eerst even rustig bijkomen!

Zeker komt er een kans voor eenieder om kennis te maken met Kieran Kuyanda en uiteindelijk ook een echte Meet & Greet met handtekeningen enzo ;-)))

En natuurlijk zullen we de blog nog wel even bijwerken als we weer op Vaderlandse bodem geland zijn :-)

Als we eenmaal terug zijn is het nog niet helemaal afgelopen want dan hebben wij nog de:
Adoptie naar Nederlands recht - adoption to Dutch law (om de Nederlandse Nationaliteit te verkrijgen - to receive Dutch citizenship)

Afhankelijk van wanneer je de procedure begonnen bent (Beginsel toestemming - BKA nummer) is de adoptie naar Nederlands recht 'automatisch' en wordt er een Nederlands paspoort uitgegeven.
Dit aan iedereen die vanaf 2007 in de procedure zit, helaas "wij zijn van 2006" en vallen hier dus buiten.
Nu dachten we dit al en kennen we de (vervolg) procedure nog van Ethiopie, maar wel jammer dat ook dit nog eens tijd (en geld) gaat kosten...

Okay...............................  Dus nog een paar spannende momentjes en dan zou het vandeweek 'rond' moeten zijn en is er (nog meer)  "rust in de tent" en mag dan echt de vlag uit :-)

Somewhere earlier in this series about the procedure I said there would 4 parts to this, well this is the last one.  After 3A now 3B, from the Judgement to the finalisation of the Kenyan procedure here.

Out of the blue on the evening of 4th April at 9.00pm we got a text message, 'Your Judgement was delivered today and the Adoption is granted'. The week after was quiet and then on 18th April we received the Adoption Order by e-mail.

Adoption Certificate: this document came a week later and replaces or acts as (at the moment, though the government wants to change this), the birth certificate and comes from the Registrar in Sheria House.
The Judgement (on paper): the Judgement is typed out on paper and because we also needed this for the passport application (we were told), we had asked the lawyer to get us a copy but we weren't able to collect it till today (10th May) because it was missing a signature from the judge.  I think this document isn't usually given to parents as standard.
Legalisations - certified copies: The Adoption Order and Certificate have to be certified as original copies by the lawyer because you need both of these to apply for the COC, Certificate of Conformity.

Our lawyer also gave us our file (or a copy of it) with almost all the documents in it (minus the reports that had been written about us but it still ran to over 60 pages) which will be useful for the evaluation with our adoption agency in The Netherlands.

We requested this document (using the application form, see list in post 4) on Friday 26th April at the  Children's Department. This was the same place where we had had an interview previously.  The man who accepted it off us, who was also present at our second court hearing, said that it would be ready within a week.......

Unfortunately when I went by a week later to see if it was ready, no-one had even looked at our application yet.  The document has an official seal and must be signed by the head of the Children's Department and the chairperson of the NAC - National Adoption Committee, it is getting both these signatures that usually causes the hold up.

Happily, yesterday Thursday 9th May, we received a text message that the COC was ready and we could go and get it today (Friday 10th May).

Passport
Because our procedure has been going on so long (we started the second adoption process in 2006), we have an 'old' approval from the Ministry of Justice in The Netherlands. The consequences of this are that we can only request a Kenyan passport for Kieran and not a Dutch one.

Today, Friday 10th May it was the big day and Jane, Kieran and I went together with someone who provides immigration services, to apply for Kieran's first passport.  (See list in post 4). After filling in everything on the form I had to sign.  We found this slightly funny as all 3 of us had to be there but no-one looked at us or spoke to us ;-)   Kieran had to look seriously at the camera and sit still (difficult when you are 4) for a digital photo and within 45 minutes we were outside again. 

We have chosen for a speedy service to get Kieran's passport which has cost more, but we know that the passport will be delivered to us on Tuesday evening next week.

Visa and MVV
And then one more step in 2 parts: to the Dutch Embassy and prior to that, booking our flights home.  In order to request a visa for Kieran we have to have the flight tickets booked.  So we need to know for sure that the visa will be ready in time.  So Monday morning I will be calling the Embassy for some advice.  What we do already know is that the MVV (temporary residence permit) has been approved and is ready for us at the Embassy; this was already organised between us, Wereldkinderen in The Netherlands and the Embassy staff.  (This ensures that Kieran can stay in The Netherlands with us when his visa expires).

Our visas  (in Kenya) ...
Last Thursday morning Jane and I had a 'crisis meeting', we had heard nothing at that point about the CIC and knew that the Children's Department was closing for 2 weeks.  So.........stress!  Because on Tuesday 14th May our visas expire after 9 months in Kenya (renewal costs a lot of money and for how long can you stay??)*  If the Children's Department didn't have the COC for us by Friday (today), then it wouldn't be ready till 27th May at the earliest.  And I have an agreement with my employer that I will go back to work this month!

So, we went to clear our heads for a walk and a cup of coffee at Java Adams Arcade to discuss Plan B.

What if ???
(I would fly home with Matthew and Jane and Kieran would stay in Kenya and we would arrange an affidavit via the lawyer to permit Jane alone to apply for a passport and visa for Kieran, was our idea).

* We have now agreed with our contact at the immigration services company that we will go for the shortest (and cheapest) option to extend our visas for 2 more weeks which brings us to 28th May.

Yes, well, when are we going home?
We will only know definitely next week, when we have the passport in our poessession, are sure about the duration to get the visa and have booked the tickets.  Probably after Whitsun (which they don't celebrate here), and then we want to settle in quietly at home.

And of course we will continue to work on the blog once we are back home because..... it's not over then.
Then we need to arrange the adoption according to Dutch law for Kieran to get Dutch citizenship.

Depending when you being your procedure (your original permission number/BKA number from the Ministry is all-important) the adoption to Dutch law is automatic and you can get a Dutch passport in Kenya.  This is for everyone who started their adoption procedures after 2007.  However as we are from 2006, we fall outside this law.  It is unfortunate that this is again going to take time (9 months) and money, but at least we will be back home for this second part of the adoption procedure. 
Okay...............................  so a few more stressful moments to come and then next week everything should be arranged and we can relax and celebrate!
